Law360 interviewed Matt Addison, Reno office Managing Partner and Co-Chair of our Construction Law & Litigation Practice, for a Q&A published in Real Estate Authority. Matt shares his insights on the increasing frequency of force majeure arising in construction litigation, particularly in delay claims. Matt describes the force majeure situation in terms of how COVID related supply chain difficulties upended planning, estimating, and ordering. Instead of implementing helpful lessons learned, in today’s post-pandemic environment there is a frequent unscrupulous abuse of force majeure in an attempt to cover tracks of negligent parties who fail to anticipate, order in a timely manner, investigate delivery time frames, etc. “In other words, force majeure is used to cry wolf now,” said Matt. Matt also shares his views on the outlook of Nevada’s construction industry in terms of the development landscape, business expansion led by Economic Development Authority of Western Nevada (EDAWN), and the overarching issue of water.

Arbitration: What to Choose and Why?” at the Litigation Counsel of America’s Spring Retreat. Pat is a Senior Fellow of the LCA and a Co-Founder and Advisory Board member of LCA’s Complex Commercial Litigation Institute. The Litigation Counsel of America is an invitation-only trial lawyer honorary society with a limited membership of 3,500 Fellows, representing less than one-half of one percent of American lawyers. Senior Counsel A.J. "Bud" Hicks will share his knowledge and insights as a member of a panel discussing the topic of “Prosecution and Defense of Organized Crime” at the 2024 District Court Conference. Bud’s background includes serving as Chief Deputy Attorney General for the State of Nevada on gaming matters and as counsel to the Nevada Gaming Commission in a landmark case that upheld the constitutionality of Nevada’s gaming regulatory structure which helped rid Las Vegas’ gaming industry of the last vestiges of organized crime. Bud also worked on the first Internal Reporting System and Compliance Plan accepted by the NGC that became the model for Gaming Compliance Plans.
